1Agreement and eligibility
The Service is offered for business / professional use by gyms, studios, and similar fitness businesses. You represent that you have authority to bind the Customer organization, that you are at least 18 years old, and that you will use the Service in compliance with applicable law.
If you use the member mobile app, you also agree to use it only as authorized by your gym (the Customer tenant).
2The Service
FitForge is gym management software that may include memberships and plans, enquiries, desk billing and a transactions ledger, expenses, classes and coaches, trainers, multi-branch operations, role-based access, WhatsApp templates/campaigns, QR check-in, a visit leaderboard, and a member mobile app. Features may vary by plan and configuration.
We may modify, suspend, or discontinue features with reasonable notice when practicable. We do not guarantee uninterrupted or error-free operation.
3Accounts and access
- You must provide accurate registration information and keep credentials confidential.
- You are responsible for activity under your accounts and for promptly notifying us of unauthorized access.
- Customer administrators control invites, Owner / Manager / Staff roles, and branch permissions within their tenant.
- We may suspend accounts that pose a security risk, violate these Terms, or fail to pay fees when due.
4Customer data and privacy
Customer retains ownership of Customer Data uploaded or generated in its tenant (including member, enquiry, billing, attendance, and messaging-related data). CodingRoof Software Technologies Private Limited processes Customer Data to provide the Service as described in the Privacy Policy.
Customer is responsible for: (a) providing required notices and obtaining consents from members, staff, and other individuals; (b) the accuracy and lawfulness of Customer Data; (c) lawful use of WhatsApp and any messaging to contacts; and (d) configuring retention and access appropriately.
Our Privacy Policy explains personal data practices for the Service and is incorporated by reference.
5Acceptable use
- Do not misuse the Service, probe vulnerabilities without authorization, or attempt to access other tenants’ data.
- Do not upload unlawful, infringing, or harmful content.
- Do not use the Service to spam, harass, or send messages in violation of WhatsApp or applicable telecom/marketing laws.
- Do not reverse engineer the Service except to the extent permitted by law.
- Do not resell or white-label the Service unless we agree in a separate written contract.
6Fees, trials, and upgrades
We may offer a free trial (currently advertised as 14 days) and paid subscription plans. Fees, limits, and inclusions are described on the pricing page or in-app and may change prospectively.
Paid FitForge plan upgrades are processed via Razorpay. Taxes may apply. Unless required by law or expressly stated otherwise, fees are non-refundable once a paid period begins.
7Intellectual property
We and our licensors own the Service, software, branding, and documentation. Customer owns Customer Data. Feedback you provide may be used by us without obligation to you.
8Confidentiality
Each party may receive confidential information of the other. The receiving party will protect it with reasonable care and use it only to perform under these Terms, except for information that is public, independently developed, or required to be disclosed by law.
9Warranties disclaimer
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR BE ERROR-FREE.
10Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CodingRoof Software Technologies Private Limited WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, OR DATA. OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE FEES PAID BY YOU TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.
11Indemnity
Customer will defend and indemnify CodingRoof Software Technologies Private Limited against claims arising from Customer Data, Customer’s use of the Service (including messaging to members/leads), or Customer’s breach of these Terms or applicable law.
12Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access for material breach, non-payment, legal risk, or misuse. Upon termination, your right to use the Service ends. Provisions that by nature should survive (including IP, confidentiality, disclaimers, liability limits, and indemnity) will survive.
13Governing law
These Terms are governed by the laws of India. Courts at Madurai, Tamil Nadu, India shall have exclusive jurisdiction, subject to any mandatory consumer or other protections that cannot be waived.
14Changes
We may update these Terms by posting a revised version with a new “Last updated” date. Continued use after the effective date constitutes acceptance, except where additional consent is required by law.
